15.04(1) Under certain circumstances, as described in section 20.15(10) of this revenue procedure, a taxpayer may request a continuance of an election by submitting a request, in a form that the Associate office determines to be sufficient, accompanied by evidence of the taxpayers adverse financial condition and a clear and concise description of why the taxpayer cannot reasonably expect to meet the deadlines described in section 20.15(10) of this revenue procedure. If no continuance is requested, the election will terminate on the 15th day after the day the notice of final determination is mailed to the taxpayer. The Associate office will make an initial determination concerning the request for a continuance. The Associate office will issue a determination letter, in the form of Notice of Final Determination, to the taxpayer within 60 days of the date of the request. In most cases, this determination will be mailed to the taxpayer within 21 days of the date of the request. After the taxpayer is notified of the decision denying a continuance of the election, the taxpayer has 60 days to file an appeal of the decision to the Commissioner.
